Sally-Save-Water™ Program Elements License Terms & Conditions

You (“Licensee”) are about to purchase a license for Sally-Save-Water Program Elements which allows you, for a specified period of time, to use and access one or more of the Sally-Save-Water Program Elements (Hereinafter collectively the “Works”)

The Works are the property of Diana Lowery (“Licensor”), and Licensor grants you a limited, non-exclusive, revocable license to make use of the Works and access the Works through the Sally-Save-Water Website, based on the Program Elements and the subscription period, you have selected.

Your license allows you to access the Works online via Licensor’s website, and to make copies of the Works for distribution to, and access by, the public, and to display and perform the Work publically on your website, and in television advertisements. At the expiration of your license term all of these licensed activities must cease. There may be a processing time of up to 48 hours from the time of your checkout to the time your access to the Works begins.

The Works are licensed, not sold, to you, and Licensor retains ownership of all copies of the Works. You may not assign these rights, or any part of them, nor transfer or sub-license your rights under this License, to any third party. Licensee agrees that no rights in the Work are retained by Licensee.

Licensor hereby confirms that it owns the entire title, right and interest in and to the Work, including the right to reproduce, prepare derivative works based upon the copyright in the Work, distribute by sale, by rental, lease or lending, by any other transfer of ownership, or otherwise; to perform publicly; and to display the Work; All Sally-Save-Water trademarks, service marks, trade names, logos, domain names, and any other features of the Sally-Save-Water brand are the sole property of Licensor.

Licensee agrees to take all reasonable actions and cooperate as is necessary to protect the copyright of the Work and Licensor’s Trademarks, and further agrees to notify Licensor in the event that Licensee becomes aware of infringement of the Works as a result of the rights granted Licensee under this Agreement.

The California state courts of San Joaquin County (or, if there is exclusive federal jurisdiction, the United States District Court for the Central District of California) shall have exclusive jurisdiction and venue over any dispute arising out of or relating to this Agreement, and Recipient hereby consents to the jurisdiction and venue of such courts. This Agreement shall be governed by and construed in accordance with the laws of the State of California exclusive of its choice of law principles.

All terms of this Agreement are applicable to any portion or part of the Work, as well as the Work in its entirety.
